It’s hard to tell how seriously my child is injured. Can I wait to file a lawsuit?

In Kentucky, you often have a year from the date of the injury to file a personal injury claim. However, pediatric injuries may not manifest as quickly as injuries do in adults. In some cases, a statute of repose applies instead. For example, in product defect cases, if no injury occurs in eight years after a product was manufactured, it is presumed not to be defective under Kentucky law.
